Medical and Dental Malpractice

Medical malpractice is the failure of a health care provider to follow the accepted standard of care that causes injury to the patient. Medical malpractice can lead to serious injury, mental anguish, long term disability, and even death. Slip and Trip and Falls:  Businesses generally must provide a safe environment for their customers. They can be held liable for injuries to their invitees caused by unsafe conditions on the premises, if they had actual notice of the hazard, or constructive notice of it as a result of the length of time it existed. Actual or constructive notice may not need to be shown if an injury is caused by a hazard inherent in the operation of self-service areas of certain businesses, such as grocery stores. A landlord may also be held responsible for injuries to its tenants caused by an unsafe condition in a common area of the premises used by all of the tenants, if the landlord has notice of the hazard that causes the injury.

Dog Bites:  Although dogs are often considered our best friends, they are still animals and sometimes will bite without provocation. Dog bites can be minor and cause no lasting harm, but others can be terrifying and leave lasting physical and emotional scars. In Washington, dog owners are strictly liable for injuries caused by unprovoked dog attacks of individuals lawfully on the premises.

Products Liability:  A product may be defective in design, either if the foreseeable risk of harm from the product could have been reduced by a reasonable alternative design, or if it is more dangerous than an ordinary consumer would expect. Inadequate warnings or instructions concerning the use of a product are another possible basis for a product liability claim. A product may be defectively manufactured if it is unreasonably unsafe because it deviated in some material way from design specifications for it, or from otherwise identical units in the same product line. Product manufacturers are also liable for harm caused by a product that is not reasonably safe because it did not conform to warranties made or implied about the product.

Nursing Home Abuse/Neglect:  Unfortunately, many nursing home and assisted living facility residents suffer physical, mental and emotional abuse and neglect from the facility’s staff. Suspected abuse, neglect and financial exploitation may be reported to the Washington State Department of Social and Health Services. They explain the process on this page of their website. Washington statutes also provide for personal injury claims for damages caused by abandonment, abuse, financial exploitation, or neglect of vulnerable elderly adults, either while they are residing at a facility, or as a result of care from a home care agency while residing at home.

Wrongful Death

A wrongful death claim arises in Washington when the death of a person is caused by the wrongful act or neglect of another.  A wrongful death claim is a personal injury claim brought by the personal representative of the victim’s estate on behalf of certain statutory beneficiaries. The primary beneficiaries of a wrongful death claim in Washington are the spouse and children of the deceased person. If there are no primary beneficiaries, a wrongful death action may be brought for the benefit of the parents or siblings of the deceased person.
